Divorce – In 1975 the Family Law Act established the principle of no-fault divorce in Australia. Divorce applications are heard separately from any children and property issues that may be in dispute. The only ground for divorce is that the marriage has broken down irretrievably. That is, that there is no reasonable likelihood that the couple will get back together. The couple must have been separated for at least 12 months and one day to satisfy the Court that the marriage has broken down irretrievably.
